ETE AND D-6 FORMS

Morera Asesores & Auditores would like to remind you of the importance of complying with the legal obligations related to the ETE (Foreign Transaction Survey) and D-6 forms, established by the Bank of Spain. The correct presentation of these documents guarantees regulatory compliance and avoids possible sanctions. Below, we provide you with a detailed summary of each one:

ETE Form:

This form is intended for all natural and legal persons resident in Spain who:

  • Carry out economic or financial transactions with non-residents.
  • Maintain assets or liabilities abroad.

Requirements:

The ETE must be filed when the total amount of transactions carried out or balances held abroad during the previous year exceeds one million euros. In the event that the amount is less, filing will not be necessary, unless expressly requested by the Banco de España.

Deadline:

Must be sent before the the 20th of January each year, reporting the transactions and balances corresponding to the previous financial year.

Form D-6:

This form is compulsory for residents in Spain (individuals and legal entities) who hold investments in negotiable securities abroad, such as shares or participations deposited in foreign entities.

Requirements:

The D-6 must be filed when the total value of the investments is equal to or greater than 10% of the voting rights or equal to or greater than 10% of the capital of the company.

Deadline:

  • Annual return: filed during the month of January, reporting on the securities held as at 31st of December of the previous year.
  • Prior declaration: Mandatory for initial investments in marketable securities located abroad.
